Human cognition affects the result of symbolic activity. Evidentiality is a linguistic concept which encodes the source of information and expresses the attitude and confidence of speaker. This paper collects 31 judgments from the Supreme People’s Court (SPC) and local people’s courts in the People’s Republic of China (P.R.C) as the research corpus, and analyzes the evidentiality in four aspects: information source, lingual form, evidential function and speaker’s attitude of the information. It is found in this study that: 1) The (...) information sources are divided into four types as cultural belief, sensory experience, verbal rumor and inferential hypothesis; 2) Lingual form consists of three categories: vocabulary, phrase and compound sentence; 3) Evidentiality in court judgments performs four functions: support with citation, induction with description, paraphrase with less responsibility and summarization with reasoning; 4) The reliability of evidentiality presents a two-tier structure based on different information sources. From the perspective of Peirce’s semiotics, the paper analyzes the judicial practice of court judgments with actual data and proposes some suggestions. (shrink)

RÉSUMÉDans cet article, j'explore comment nous pouvons nous servir d'idées philosophiques provenant du Yogācāra chinois afin d’élargir le projet du féminisme bouddhiste. En me concentrant sur les écrits de Xuanzang (env. 602–664) et de son disciple Kuiji (632–682), j'examine comment la théorie de la conscience du Yogācāra peut être interprétée comme un récit genré de la non-dualité. Ainsi, le terme «dialectique du Yogācāra» serait employé afin de décrire cette théorie de la non-dualité qui souligne la fluidité et la transformabilité. The Crowd: A Study of the Popular Mind (French: Psychologie des Foules; literally: Psychology of Crowds) is a book authored by Gustave Le Bon that was first published in 1895. In the book, Le Bon claims that there are several characteristics of crowd psychology: "impulsiveness, irritability, incapacity to reason, the absence of judgement of the critical spirit, the exaggeration of sentiments, and others. Le Bon claimed that "an individual immersed for some length of time in a crowd soon finds himself (...) - either in consequence of magnetic influence given out by the crowd or from some other cause of which we are ignorant - in a special state, which much resembles the state of fascination in which the hypnotized individual finds himself in the hands of the hypnotizer. The notion of ‘gentle barbarism’ was developed during our critical analysis of the discourses and mechanisms of ‘modernisation’ that emerged in the context of the movement for permanent reform (in education, the public services and business management), in which public bodies and businesses have been engaged since the 1980s. According to the Ignorance Factivity Thesis, for every proposition p, one is ignorant of p only if p is a truth. By contrast, according to the Ignorance Non-Factivity Thesis, it is false that, for every proposition p, one is ignorant of p only if p is a truth. I argue that, on balance, the case for the latter thesis is stronger than the case for the former.

Forty years after it first appeared, Sidney Shoemaker's much-read article, "Time without Change" , with its striking thought experiment, still dominates discussions of this intriguing topic. And rightly so: it is imaginative, subtle, and controversial. But times have changed, as they do, and in particular, the epistemological context in which Shoemaker was writing, overshadowed as it was by verificationism, no longer constrains our thinking as once it did. From 1919 to 1929, the great Hungarian Marxist philosopher Georg Lukács was one of the leaders of the Hungarian Communist Party, immersed not simply in theorising but also in significant practical-political work. Along with labour leader Jenö Landler, he led a faction opposing an ultra-left sectarian orientation represented by Béla Kun. If seen in connection with this factional struggle, key works of Lukács in this period – History and Class Consciousness, Lenin: A Study in the Unity of His Thought, Tailism (...) and the Dialectic and ‘The Blum Theses’ – can be seen as forming a consistent, coherent, sophisticated variant of Leninism. Influential readings of these works interpret them as being ultra-leftist or proto-Stalinist. Such readings distort the reality. Lukács’s orientation and outlook of 1923–9 are, rather, more consistent with the orientation advanced by Lenin and Trotsky in the Third and Fourth Congresses of the Communist International. After his decisive political defeat, Lukács concluded that it was necessary to renounce his distinctive political orientation, and completely abandon the terrain of practical revolutionary politics, if he hoped to remain inside the Communist movement. This he did, adapting to Stalinism and shifting his efforts to literary criticism and philosophy. But the theorisations connected to his revolutionary politics of the 1920s continue to have relevance for revolutionary activists of the twenty-first century. (shrink)

This paper argues that economic rationality and ethical behavior cannot be reduced one to the other, thus casting doubt on the validity of assertions such as ‘profit is ethical’ or ‘ethics pays’. In order to express ethical dilemmas in a way which opposes economic interest with ethical concerns, we propose a model of rational behavior that combines these two irreducible dimensions in an open but not arbitrary manner. Behaviors that are neither ethical nor profitable are considered irrational . However, behaviors (...) that are profitable but unethical, and behaviors that are ethical but not profitable, are all treated as rational . Combining ethical concerns with economic interest, ethical business is in turn seen as an optimal form of rationality between venality and sacrifice. Because everyone prefers to communicate that they act ethically, ethical business remains ambiguous until some economic interest is actually sacrificed. We argue, however, that ethical business has an interest in demonstrating its consistency between communication and behavior by a transparent attitude. On the other hand, venal behaviors must remain confidential to hide the corresponding lack of consistency. This discursive approach based on transparency and confidentiality helps to further distinguish between ethical and unethical business behaviors. (shrink)

Surface presentism is the combination of a general relativistic physics with a presentist metaphysics. In this paper, we provide an argument against this combination based on black holes. The problem focuses on the notion of an event horizon. We argue that the present locations of event horizons are ontologically dependent on future black hole regions, and that this dependence is incompatible with presentism. We consider five responses to the problem available to the surface presentist, and argue that none succeed. ArgumentThis paper challenges the use of the notion of “culture” to describe a particular organization of mathematical knowledge, shared by a few mathematicians over a short period of time in the second half of the nineteenth century. This knowledge relates to “geometrical equations,” objects that proved crucial for the mechanisms of encounters between equation theory, substitution theory, and geometry at that time, although they were not well-defined mathematical objects. The description of the mathematical collective activities linked to “geometrical equations,” and (...) especially the technical aspects of these activities, is made on the basis of a sociological definition of “culture.” More precisely, after an examination of the social organization of the group of mathematicians, I argue that these activities form an intricate system of patterns, symbols, and values, for which I suggest a characterization as a “cultural system.”. This article presents a review on two methods based on dynamic mode decomposition and its multiple applications, focusing on higher order dynamic mode decomposition and spatiotemporal Koopman decomposition. These methods are purely data-driven, using either numerical or experimental data, and permit reconstructing the given data and identifying the temporal growth rates and frequencies involved in the dynamics and the spatial growth rates and wavenumbers in the case of the spatiotemporal Koopman decomposition. Thus, they may be used to either identify and (...) extrapolate the dynamics from transient behavior to permanent dynamics or construct efficient, purely data-driven reduced order models. (shrink)

One of the most venerable and enduring intuitions in epistemology concerns the relationship between true belief and knowledge. Famously articulated by Socrates, it holds that true belief does not suffice for knowledge. I discuss a matching intuition about ignorance according to which true belief does not suffice for the absence of ignorance. I argue that the latter intuition undercuts the New View of Ignorance and supports the Standard View of Ignorance.

Contemporary engineering education recognises the need for engineering ethics content in undergraduate programmes to extend beyond concepts that form the basis of professional codes to consider relationality and context of engineering practice. Yet there is debate on how this might be done, and we argue that the design and pedagogy for engineering ethics has to consider what and to whom ethics is taught in a particular context. Our interest is in the possibilities and challenges of pursuing the dual imperatives of (...) socialization and critique. Socialization involves creating opportunities for all, in a diverse cohort of students, to access and engage with the dominant professional engineering ethics knowledge, while critique involves engaging with a range of ways of knowing, valuing, being and using language as relevant in contemporary engineering practice. We identify conceptual tools from engineering ethics and ethical pedagogy in education scholarship for our context. We illustrate how we use these tools systematically to strengthen our reflective practice in a first-year university engineering ethics module to a deeper form of reflexivity. Specifically, we explore the ways in which we attend to the dual imperatives and also highlight opportunities that we miss. We identify as key opportunities design choices such as how we formulated questions and prompts, and how we attended to content, context and language in selecting classroom texts. Other key opportunities were pedagogical choices of when and how to use student contributions in discussion, and what was made explicit in the classroom and assessment. We share our plans to take our learnings forward in our practice and consider the generative possibilities of these learnings and the concepts in other contexts. (shrink)

Science communication has gained high importance in the current knowledge and risk society. Nevertheless, there is still a lack of qualitative studies on how non-experts and experts engage in opinionated scientific debates and which linguistic devices they use to gain influence on other people’s attitudes toward a scientific issue. In our study, we examine dialogical modes of science communication (i.e. weblogs) used by bloggers and audiences to engage into opinionated discourse about scientific endeavors. As those exchanges easily lead to controversies (...) between different points of views, stances and attitudes, we focus from a rhetorically-driven linguistic perspective on devices to persuade the other participants and readers and to control the discourse. Hence, we ask which linguistic instruments are used to gain influence on influence. The aim of our study is to get deeper insights into the persuasive strategies mainly used in those forms of external science communication. (shrink)

In this paper, a mathematical model of the respiratory mechanics is used to reproduce experimental signal waveforms acquired from three newborn lambs. As the main challenge is to determine specific lamb parameters, a sensitivity analysis has been realized to find the most influent parameters, which are identified using an evolutionary algorithm. Results show a close match between experimental and simulated pressure and flow waveforms obtained during spontaneous ventilation and pleural pressure variations acquired during the application of positive pressure, since root (...) mean square errors equal to 0.0119, 0.0052 and 0.0094. The identified parameters were discussed in light of previous knowledge of respiratory mechanics in the newborn. (shrink)

The aim of this article is to critically build on Justin Biddle and Anna Leuschner’s characterization of epistemologically detrimental dissent in the context of science. We argue that the presence of nonepistemic agendas and severe nonepistemic consequences offers neither necessary nor sufficient conditions for EDD to obtain. We clarify their role by arguing that they are contingent enabling factors, not stable difference-makers, in the production of EDD. We maintain that two stable difference-makers are core to the production of EDD: production (...) of skewed science and effective public dissemination. (shrink)

It so happens that classical physical theories can be interpreted as a representation of local interactions between systems with determinate properties. Orthodox quantum mechanics, which is one of our most experimentally well-confirmed theories, is notoriously resistant to being interpreted in terms of the above framework. Bell-type theorems and Bell-type experiments have made such an interpretation impossible. In the early sixties, John Bell demonstrated that any theory that represents its domain in terms of the above framework satisfies a set of inequalities, (...) the so-called Bell inequalities. Experiments on quantum phenomena violate Bell-type inequalities. By a simple modus tollens, the upshot is that no theory that includes all the elements of the above framework can recover all statistical predictions of quantum mechanics. Philosophers have been trying to interpret this result, that is, to understand what the world might be like if it is true that physical interactions between systems are non-local, or that physical systems do not possess determinate properties. This line of thought found its climax in program of Òexperimental metaphysicsÓ that developed after the violation of Bell-type inequalities was observed. Experimental metaphysics consists in deriving metaphysical conclusions from the Bell-type experimental results. The mainstream interpretation within experimental metaphysics is that Bell-type experiments force us to accept the existence of a form of non-locality at the ontological level, but a form that we can consider benign because it is of a non-causal type. In my dissertation, I assess to what extent philosophical investigation can help us decide what the world is like on the basis of our best physical theories, from the point of view of the quantum domain and with an emphasis on Bell-type phenomena. My conclusions point to a more modest view on the possible achievements of philosophy of physics than the experimental metaphysics program would have us believe. In the first part of my dissertation, I investigate what role philosophy of physics can legitimately hope to play in the development and evaluation of various accounts of quantum phenomena. I claim that it is not the role of philosophy of physics to impose criteria of acceptability on physical theories, in addition to coherence and empirical adequacy. By contrast, I take in my dissertation that the legitimate role of philosophy of physics is to clearly determine what is imposed by the phenomena and our best theories from what is a matter of preference on the basis of the structural analysis of the phenomena and theories. In the second part of my dissertation, I turn to the more specific case of the interpretation of Bell-type theorems and Bell-type phenomena. I undertake a systematic examination of the mainstream interpretation. I show that the mainstream interpretation includes three claims, one about locality, another one about causation and a last one about holism. I utilize theories of locality and causation in order to assess these three claims. On the one hand, the upshot of my analysis is that the claim about locality can be supported by a rigorous theory of locality. On the other hand, no theory of probabilistic causation can support the claims of the mainstream interpretation about causation when it is construed as a strong program of experimental metaphysics yielding conclusions about the ontology of the world. That said, weakened versions of the mainstream interpretation, those that do without conclusions about the ontology of the world, can be made compatible with some theories of probabilistic causation. In particular, the mainstream interpretation can be rigorously supported if its claims are restricted to the empirical level. (shrink)
